Pinda Akta 355 dengan tingkatkan kadar denda maksimum, tempoh penjara - PGSM

KUALA LUMPUR: Akta Mahkamah Syariah (Bidang Kuasa Jenayah) 1965 (Akta 355) wajar dipinda dengan sekurang-kurangnya kadar denda maksimum dinaikkan daripada RM5,000 kepada RM20,000 atau RM50,000 dan tempoh pemenjaraan lebih panjang.

Presiden Persatuan Peguam Syarie Malaysia (PGSM), Musa Awang, berkata Mahkamah Syariah tidak akan diperkasa jika tanpa pemindaan akta itu.
Beliau berkata, kebanyakan pesalah jenayah syariah akan membuat pengakuan bersalah (walaupun mereka tidak bersalah) hanya disebabkan kadar denda yang rendah.

Katanya, ini menyebabkan banyak kes jenayah syariah tidak berkembang dari segi akademik, perjalanan kes, laporan kes, penghakiman, penguatkuasaan dan pendakwaan.

“Hukuman sedia ada juga tidak setimpal dengan kesalahan dilakukan. Sebagai contoh, kesalahan doktrin atau ajaran sesat hanya boleh dikenakan denda tidak melebihi RM5,000 atau penjara tidak lebih tiga tahun.

“Sedangkan perbicaraan kes berkenaan boleh menjangkau bertahun-tahun. Begitu juga dengan kesalahan berzina, melacurkan diri, melacurkan isteri serta anak dan sebagainya.

“Tahap kompetensi Hakim Syarie, pegawai mahkamah, peguam syarie, pendakwa syarie, pegawai penguat kuasa agama serta Mahkamah Syariah keseluruhannya akan meningkat jika Akta 355 dipinda. Jika tidak, selagi itulah Mahkamah Syariah akan berada pada takuk sebagaimana hari ini,” katanya dalam satu kenyataan, hari ini.

Musa berkata, kerajaan juga tidak perlu khuatir dengan bayangan Rang Undang-undang (RUU) 355 yang pernah cuba dibawa sebelum ini melalui RUU Persendirian.

“Ini kerana kerajaan Pakatan Harapan (PH) boleh mengemukakan cadangan pindaan Akta 355 dalam versi lebih kemas dan tuntas berbanding sebelum ini,” katanya.

Media sebelum ini melaporkan Timbalan Menteri di Jabatan Perdana Menteri (JPM), Fuziah Salleh, berkata kerajaan berhasrat meminda Akta 355 sebagai langkah dan komitmen negara memperkasakan Mahkamah Syariah secara komprehensif.

KUALA LUMPUR 21 Feb. - Persatuan Peguam Syarie Malaysia (PGSM) mengucapkan terima kasih kepada Menteri di Jabatan Perdana Menteri, Datuk Seri Dr. Mujahid Yusof dan Kabinet kerana bersetuju menggubal Rang Undang-udang (RUU) Profesion Guaman Syarie (Wilayah-Wilayah Persekutuan).

Presidennya, Musa Awang berkata, undang-undang yang bakal digubal kelak dapat mengangkat profesionalisme peguam syarie di negara ini.

Katanya lagi, di samping itu dapat membantu menyelesaikan masalah ketidakseragaman dan ketidakselarasan amalan undang-undang di antara negeri.
“Ia juga menjadi bukti bahawa kerajaan memberikan komitmen baik dan bersungguh-sungguh dalam memartabatkan institusi perundangan syariah dan profesion guaman syarie di negara ini.

“Kami berharap RUU berkenaan menjadi model bagi penyeragaman undang-undang profesion guaman syarie di negara ini,” katanya dalam kenyataan di sini hari ini. – UTUSAN ONLINE


'Nikah ekspres' a worrying trend among Malaysian Muslim couples, say experts

SHAH ALAM: The practice of ‘nikah ekspres’ (express marriage solemnisation) among Muslim couples is growing, and is driven partly by an explosion in the number of dubious individuals offering the service.

According to Universiti Kebangsaan Malaysia (UKM) Institut Islam Hadhari director professor Datuk Aziah Mohd Awal, many couples want a short and sweet process to becoming husband and wife, but the proper procedure involves observing laws and attending court sessions that can be arduous and time-consuming.

“Many (couples) are bogged down by the nitty-gritty issues and procedures (involved in getting married). To be wedded in Malaysia, one needs to do everything from filling in and submitting forms to the religious office, to getting consent from a judge.

“This process takes time.

“(But) a ‘nikah ekspres’ is quick. It oversteps the process. It can be completed in a day, but it is normally conducted outside of Malaysia,” she said.

Providers of ‘nikah ekspres’ services place advertisements to catch the eye of would-be newlyweds, and promise a quick solemnisation process assisted by religious officers, lawyers and even syarie judges.

It is believed that these “service providers” are ex-religious officers or former lawyers who are no longer authorised to carry out solemnisation ceremonies, but are lured by the promise of a quick buck.

“There are agents who advertise that a solemnisation process would be assisted by syarie lawyers… they have a panel… and even syarie judges.

“There are also companies that take up full-page advertisements on ‘nikah Thailand’,” said Malaysia Syarie Lawyers Association (PGSM) president Musa Awang.

Aziah and Musa were speaking during Sinar Harian’s Bicara Minda discourse on the issue of ‘nikah ekspres’ at Kompleks Karangkraf at Section 15 here, today.

Also on the panel was UKM’s Centre for Contemporary Fiqh and Syariah Compliance lecturer associate professor Dr Zuliza Mohd Kusrin.

The discussion was moderated by Arba Foundation chief executive officer Azlan Shah Nabees Khan.
